GENERAL TERMS AND CONDITIONS
§1 Scope
These General Terms and Conditions apply to all orders placed by consumers and business customers through the Vitalix SAS online shop. The version in effect at the time the order is placed shall apply.

§3 Formation of the Contract
The presentation of products does not constitute a binding offer. By clicking the “Order with obligation to pay” button, the customer submits a binding offer to enter into a contract of sale.
The contract is concluded only when a dispatch confirmation is issued or the goods are delivered. Order confirmation emails merely acknowledge receipt of the order.
§4 Prices
All prices are stated in euros and include value added tax at the applicable statutory rate, where payable. Shipping costs are shown separately at checkout.
§5 Delivery
Delivery is available only to the countries offered in the online shop. Delivery times vary depending on the product and destination country.
Partial deliveries are permitted where reasonably acceptable to the customer. Events of force majeure or supply shortages may result in a reasonable extension of delivery times.
§6 Shipping Costs, Customs Duties and Import Charges
The applicable shipping costs are displayed during the ordering process and published on the shipping information page. Changes to shipping costs apply only to future orders.
Deliveries to countries outside the European Union, including Great Britain (England, Scotland and Wales) and Switzerland, may incur customs duties, import VAT and customs clearance or disbursement fees charged by the carrier, in addition to the purchase price and shipping costs.
To the extent that these charges are not already expressly displayed and collected at checkout, they are payable by the customer, insofar as permitted by law. The customer must pay them directly to the relevant authority or carrier. Vitalix SAS does not cover these additional charges unless expressly agreed otherwise when the order is placed.
The amount of these charges depends on the regulations of the destination country. Customers can obtain further information from the relevant customs and tax authorities.
Vitalix SAS’s statutory obligations to calculate, collect and remit taxes and duties remain unaffected.
§7 Payment Terms
Only the payment methods offered at checkout are accepted, including Shop Pay, credit cards, Apple Pay, Google Pay, PayPal, Klarna and other locally available payment methods.
Payments may be processed by external payment service providers.
§8 Retention of Title
The goods remain the property of Vitalix SAS until payment has been received in full.
§9 Statutory Rights in Respect of Defective Goods
The applicable statutory rights in respect of defective goods apply. Additional voluntary guarantees are provided only where expressly described for the relevant product.
§10 Liability
The liability of Vitalix SAS is governed by the applicable statutory provisions.
Vitalix SAS shall be liable without limitation for death, personal injury or damage to health, and for damage caused intentionally or through gross negligence.
In the event of a breach of an essential contractual obligation caused by slight negligence, liability shall be limited to foreseeable damage typical of the contract, insofar as permitted by law.
§11 Right of Withdrawal
Consumers have a statutory right to withdraw from the contract within 14 days.

In all other respects, the applicable statutory provisions implementing the EU Consumer Rights Directive govern the right of withdrawal.

§13 Voluntary 30-Day Returns Guarantee
In addition to the statutory right of withdrawal, Vitalix SAS offers a voluntary 30-day returns guarantee.
To qualify, the goods must be returned complete, unused and undamaged.
This guarantee does not affect the consumer’s statutory rights.
§14 Data Protection
Information on the processing of personal data is available in the separate Privacy Policy.
§15 Electronic Communications
The customer agrees to receive information relating to the contract electronically, insofar as permitted by law.
§16 Consumer Dispute Resolution
Customers may initially address complaints to Vitalix SAS at info@vitalixworld.com.
If a dispute cannot be resolved following a prior written complaint to Vitalix SAS, the consumer may refer the matter to a consumer mediator free of charge, subject to the applicable statutory conditions.

The right to bring proceedings before the competent courts remains unaffected.
§17 Applicable Law
French law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods.
Mandatory consumer protection provisions of the country in which the consumer has their habitual residence remain unaffected.
§18 Jurisdiction
If the customer is a merchant or a legal entity governed by public law, the courts at the registered office of Vitalix SAS shall have jurisdiction, insofar as permitted by law.
§19 Final Provisions
If any provision of these General Terms and Conditions is or becomes wholly or partly invalid, the validity of the remaining provisions shall remain unaffected.
